Acceptance of Terms

The Services that Microsoft provides to you are subject to the following Terms of Use ("TOU"). Microsoft reserves the right to update and modify the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our web pages. When we make updates to the TOU, Microsoft will update the date at the top of this page. By using the Services after a new version of the TOU has been posted, you agree to the terms of such new version. The Services may include features or functionality that are in preview and may not work correctly or in the same way the final version may work.

Description of Services

Microsoft Artifact Registry (referred to herein as “MAR” and also known as Microsoft Container Registry or “MCR”) is the primary registry for all Microsoft-published Artifacts that offers a reliable and trustworthy delivery of container images with a syndicated catalog, while maintaining the quality that customers expect from a Microsoft product offering. Through the MAR discovery experience web properties and MAR APIs (collectively, "Services"), Microsoft provides you with access to Microsoft’s official container images and cloud-native artifacts (collectively, “Artifacts”). The Services which include any updates, enhancements, new features, and/or the addition of any new MAR discovery portal web properties or MAR APIs, are subject to the TOU.

Your Privacy

Your privacy is important to us. Please read the Microsoft Privacy Statement (the "Privacy Statement") as it describes the types of data we collect from you and your devices ("Data"), how we use your Data, and the legal bases we have to process your Data. Where processing is based on consent and to the extent permitted by law, by agreeing to these TOU, you consent to Microsoft’s collection, use and disclosure of your Data as described in the Privacy Statement.

Artifacts

The Services allow you to access and pull Artifacts published by Microsoft. Each Artifact is governed by the terms that are included with the Artifact materials and may be subject to limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations and terms. You should review the applicable terms before accessing, downloading, or acquiring any Artifacts. Any terms included with the Artifacts do not modify the TOU. Microsoft does not license any intellectual property to you from third party Package providers and is not responsible for information provided by third parties.

Artifact Legal Notice

Microsoft Artifacts are licensed under various licenses depending upon the Artifact’s content. If the Artifact has a Debian, Ubuntu or Alpine Linux base image and you want to retrieve the licenses, copyright notices or source code information for the base image and its official packages, please review the Linux Legal Metadata instructions file. If you are using a Windows based Artifact the governing licenses are referenced in the “License” section on the Artifact description page or in the Artifact itself, usually as a NOTICE or LICENSE file. All other components (whether open or closed source) are licensed as indicated either in the “License” section on the Artifact description page or in the Artifact itself.

A Artifact may incorporate material from third parties. Microsoft makes certain open source code available at https://3rdpartysource.microsoft.com, or if you want a copy of the source code in a Artifact you may send a check or money order for US $5.00, including the product name, the open source component name, and version number, to: Source Code Compliance Team, Microsoft Corporation, One Microsoft Way, Redmond, WA 98052 USA

Docker Software

Use of the Artifacts available via the Services may require that you download certain software from Docker Inc. Use of the software from Docker is governed by separate terms provided by Docker. Microsoft does not license the software to you. Microsoft is not a party to and is not bound by any separate terms between you and Docker, nor is Microsoft obligated to provide any support for the software. Using the Services

(a) Restrictions. You may access and use the Services for your personal and internal business purposes. Microsoft reserves all rights to the Services not expressly granted by Microsoft. You may not:

(i) circumvent or bypass any technological protection measures in or relating to the Services or Artifacts;

(ii) access (or attempt to access) or download any Artifact that (a) is not made discoverable by Microsoft via the Services, or (b) that includes technology that you know, or reasonably should know, cannot be legally distributed in such a manner.

(iii) disassemble, decompile, decrypt, hack, emulate, exploit, or reverse engineer any software or other aspect of the Services or Artifacts, except and only to the extent that applicable copyright law expressly permits doing so;

(iv) modify, reproduce, license, create derivative works of, publish, copy, rent, lease, sell, export, import, distribute, or lend (a) the Services, absent Microsoft permission; or (b) the Artifacts, unless otherwise permitted in the applicable Artifact license; or

(v) enable access to the Services or Artifacts in a manner intended to circumvent usage limits or quotas.

(b) Microsoft Account. You do not need a Microsoft account to access and browse the Services. However, you may need a Microsoft account to utilize Artifacts that interact with Microsoft Online Services.

(c) Throttling. We may limit the number of requests that you can make to the Services to protect our system or to enforce reasonable limits on your use of the Services.

Code of Conduct

By agreeing to the TOU, you're agreeing that, when using the Services, you will follow these rules:

1. Don't do anything illegal.

2. Don't engage in activity that is false or misleading (e.g., asking for money under false pretenses, impersonating someone else, manipulating the Services to affect rankings, or ratings).

3. Don't circumvent any restrictions on access to or availability of the Services.

4. Don't damage, disable, overburden, or impair the Services.

5. Don't engage in activity that is harmful to you, the Services, or others (e.g., transmitting viruses).

6. Don't infringe upon the rights of others (e.g., unauthorized sharing of copyrighted materials).

7. Don't engage in activity that violates the privacy of others.

8. Don't help others break these rules.

If you violate these TOU, we may stop providing Services to you, close your Microsoft or PowerShell account, revoke your access to the PowerShell APIs, or delete or unlist your Package(s).

Notices and Procedure for Making Claims of Copyright Infringement

We respect the intellectual property rights of others. If you wish to send a notice of intellectual property infringement, including claims of copyright infringement, please use our procedures for submitting Notices of Infringement https://www.microsoft.com/legal/intellectualproperty/infringement . ONLY INQUIRIES RELEVANT TO THIS PROCEDURE WILL RECEIVE A RESPONSE. We use the processes set out in Title 17, United States Code, Section 512 to respond to notices of copyright infringement.

Termination

If you no longer agree to be bound by the TOU, you must cease all use of the Services. We reserve the right to terminate or suspend your access to and use of the Services, without notice, if we believe, in our sole discretion, that (i) such use is in violation of any applicable law; (ii) such use is harmful to our interests or the interests, including intellectual property or other rights, of another person or entity; (iii) where we have reason to believe that you are in violation of the TOU; or (iv) for any reason whatsoever.

Export Laws

You must comply with all domestic and international export laws and regulations that apply to the Services and/or Artifacts (and any software, code or other technology included therein), which include restrictions on destinations, end users, and end use. Unsolicited Ideas

Microsoft does not consider or accept unsolicited proposals or ideas, including, without limitation, ideas for new products, technologies, promotions, product names, product feedback and product improvements ("Unsolicited Feedback"). If you send any Unsolicited Feedback to Microsoft through the Services or otherwise, you acknowledge and agree that Microsoft shall not be under any obligation of confidentiality with respect to the Unsolicited Feedback.

Warranties

MICROSOFT, AND OUR AFFILIATES, DISTRIBUTORS, AND VENDORS, MAKE NO WARRANTIES, EXPRESS OR IMPLIED, GUARANTEES OR CONDITIONS WITH RESPECT TO YOUR USE OF THE SERVICES. YOU UNDERSTAND THAT USE OF THE SERVICES IS AT YOUR OWN RISK AND THAT WE PROVIDE THE SERVICES ON AN "AS IS" BASIS "WITH ALL FAULTS" AND "AS AVAILABLE." YOU BEAR THE ENTIRE RISK OF USING THE SERVICES. MICROSOFT DOESN'T GUARANTEE THE ACCURACY OR TIMELINESS OF INFORMATION AVAILABLE FROM THE SERVICES. TO THE EXTENT PERMITTED UNDER YOUR LOCAL LAWS, WE EXCLUDE ANY IMPLIED WARRANTIES, INCLUDING FOR MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, AND NON-INFRINGEMENT. YOU MAY HAVE CERTAIN RIGHTS UNDER YOUR LOCAL LAWS. NOTHING IN THE TOU IS INTENDED TO AFFECT THOSE RIGHTS, IF THEY ARE APPLICABLE. YOU ACKNOWLEDGE THAT COMPUTER AND TELECOMMUNICATIONS SYSTEMS ARE NOT FAULT-FREE AND OCCASIONAL PERIODS OF DOWNTIME OCCUR. WE DO NOT GUARANTEE THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OR THAT CONTENT LOSS WON'T OCCUR, NOR DO WE GUARANTEE ANY CONNECTION TO OR TRANSMISSION FROM THE COMPUTER NETWORKS.

Limitation of Liability

If you have any basis for recovering damages (including breach of the TOU), you agree that your exclusive remedy is to recover, from Microsoft or any affiliates, distributors, and vendors, direct aggregate damages up to $10.00 USD. You can't recover any other damages or losses, including consequential, lost profits, special, indirect, incidental, or punitive. These limitations and exclusions apply even if this remedy doesn't fully compensate you for any losses or fails of its essential purpose or if we knew or should have known about the possibility of the damages. To the maximum extent permitted by law, these limitations and exclusions apply to any claims related to the TOU, the Services, and the software related to the Services.

Contracting Entity, Choice of Law, Jurisdiction

References to "Microsoft" in the TOU mean that you're contracting with Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, U.S.A. If you live in (or, if a business, your principal place of business is in) the United States, the laws of the state where you live govern all claims, regardless of conflict of law principles. You and we irrevocably consent to the exclusive jurisdiction and venue of the state or federal courts in King County, Washington, for all disputes arising out of or relating to the TOU or the Services that are heard in court.
